Blank or alarm weapons have often posed a problem for European or French legislators due to, for some models (the older ones), the possibility of transformation, or simply their resemblance to a real firearm (for the more recent ones designed so that any attempt at modification leads to destruction).
To the 1andJuly, alarm and signaling weapons are classified under category C12. To carry out a transaction, it will be necessary:
– that the purchaser has opened an account in the SIA (either as a hunter or a sports shooter, or by specifically creating an account as a "holder without title")
– that the professional registers the weapon in their LPN with the corresponding RGA number.
Starting from July 1, 2024, alarm and signaling weapons that were previously classified under i) of category D will be classified under 12° of category C and therefore subject to declaration for their acquisition.
The reporting regime for these weapons has been aligned with that of classified weapons.to the 3rd and 9th of category C:
The acquisition of these weapons is conditioned by the possession of an individualized account in the SIA and the validation of the declaration, which requires the submission of a medical certificate dated less than one month prior to the date of acquiring the weapon.
1. Obligation to have an account in the SIA to acquire a C12° weapon:
– for holders who already have an account in the SIA, the declaration is made through their individual account as a hunter, sports shooter, or holder without a title;
– Hunters and sport shooters who do not yet have a SIA account will need to create their individual account before purchasing ;
– for those who do not own a weapon, the acquisition of a category C12° weapon is also conditioned by the creation of an account"Holder without title"in the SIA. As a reminder, this process requires a valid ID, proof of residence regardless of its date if the address is current, and an email address to validate the account creation.
– clay pigeon shooters, biathletes, and collectors, for whom the SIA is not yet available, must also create an account"Holder without title."Their data, along with the assigned SIA number, will be recorded when the SIA is open to these categories of holders.
2. The declaration via the SIA:
- Hunters, sport shooters, and unauthorized holders must present a valid identity document;
– For hunters without a current validation, the transfer of the weapon can be enforced at the time of the transaction ;
The purchaser classified as a "holder without title" is not required to provide the medical certificate at the time of purchase. They have a period of 3 months from the date of declaration to upload the document to their account.
- The RGA has been updated with new entries in category C12°. ;
If the weapon does not appear in the repository, you must request the creation of a record following the usual procedure via the LPN.
3. The status of alarm and signaling weapons acquired before the 1standJuly 2024:
Weapons acquired before July 1, 2024, may be kept by their holders without being declared.
For gunsmiths, the inventory can be entered into the LPN as transactions occur.
